Efficient Dispute Prevention and Legal Support
One effective strategy to avoid trade mark disputes is law firms to get expert advice conduct a comprehensive search before selecting a trade mark. Such due diligence can reveal potential risks and help businesses choose a brand that is less likely to face legal challenges. We see many clients who believe that getting a trade marks is easy and straight forward. However, to obtain protection which works is a whole different matter. We see many self filed marks that do not have the right specifications or are descriptive and are of poor value when it comes to defending them.
Adopting a strategic approach to brand protection and trademark registration results in distinct, appealing, and enforceable brands. Businesses must be mindful of the costs associated with enforcing trade marks and recognise that allowing minor infringements can erode brand distinctiveness over time. However, using the right professional is great value and will help improve the value of the business hugely.
To ensure your chosen trade mark is unique, defendable and not already in use, it's essential to select a distinctive mark that is inherently distinctive and stands apart from others. This proactive approach helps prevent disputes and strengthens brand protection.

“Trademark registration is both an art and a science. It is important that when registering a trademark a business is able to secure the best possible asset for their business. This means navigating the tricky and unique area of trademark law and tailoring a trademark application to give a business the broadest scope of protection for their brands. The devil is in the detail and whether it's self-filed or non-specialist filed, we see marks which simply don't stand up to scrutiny when tested by opposition, invalidation or other disputes as they arise. That's why we apply our time and expertise to ensure our clients have a solid foundation for their business activity - and an asset that serves them for decades to come.”
