Formal registration is not required, nor are there any formal registration organisations in the UK. However, in the USA it is highly desirable and it can provide additional legal benefits and facilitate enforcement. The same applies in China.

  3. Duration of Protection: Copyright in written works typically lasts for the life of the author plus seventy years. For works created under pseudonyms, anonymously, or as works for hire, the duration extends to 70 years from publication or 70 years from creation, whichever is shorter. Shorter periods of copyright arise in things such as broadcasts, sound recordings and similar works.

  4. Infringement and Remedies: Copyright infringement occurs when a protected work is used without the owner’s permission. In the UK there are no official registration procedures. However, we can and do frequently advise creators on how to document and maintain copyright material ready to pursue issues that arise if it is copied. Dealing With Copyright Infringement

Tackling the different layers of infringement can seem overwhelming, but at Virtuoso Legal, we offer professional and authoritative guidance to ensure your intellectual property is robustly protected. Copyright infringement occurs when a protected work is used without the owner’s permission, potentially leading a company to significant financial and repetitional damage. This is especially the case where software, data or high value images and photographs are taken. Or where the company is a start up.

It is always useful to use the copyright symbol on your work to denote your ownership. This would look like this: © Virtuoso Legal 2024 and would indicate that the work is protected by copyright. It is not a registered right in the UK but all creative work would normally state the original creator and then have a date on it to indicate that it is a copyright work.

When we help clients become fully protected, we often register their copyright in overseas markets such as China and the USA where there are formal registration procedures. Taking legal action is then much easier in those markets, although there is a scheme known as the Berne Convention that helps people take action overseas, rather than in the High Court in the UK. Be aware of the fact that these types of action need expert solicitors and in-depth knowledge of IP rights.

Other Types of Copyright

Other common types of copyright include recording rights, broadcasting rights, music copyright, sound recordings, photography, publishing agreements and software. These rights are often referred to as the layers of an onion and need specialist copyright help to enforce them. Computer software can be copied and abused and it is always important for a copyright owner to use copyright solicitors to obtain sound legal advice to help protect their business. Copying is a serious issue and the work behind copyright is often created at significant cost to a company. By way of example, think of the cost of creating an online or printed catalogue or brochure. The business will invest in photography, music, written copyright and the layout all of which can easily be copied.

Again in relation to potential defences, material may be inadvertently copied and then in only a small part. There may be parts copied and used for fair dealing and review which could provide a defence to an act of copying.
