At Virtuoso Legal we have considerable expertise in the execution of so called Search and Freezing Orders. These used to be called Anton Piller and Mareva Injunctions and indeed the leading case law in these areas is still Anton Piller KG v Manufacturing Processes Limited [1976] and Mareva Compania Naviera SA v Bulk Carriers [1980]. The Search Orders we’ve been involved with have varied from Doorstep Delivery up Orders through to full search and seizure of documents together with a Freezing Order over the Defendants assets. Obviously such orders are taken out by the Claimant on an ex-parte basis, so as to ensure that the Defendant doesn’t destroy important documents relating to their wrong doings.
Almost universally these orders now include recovery of electronic data on servers, laptops, mobile phones, memory sticks, discs and blackberry type devices to name but a few. We are not only able to assist as Supervising Solicitors, but because of our widespread expertise we are able to assist Claimants, Defendants and instructing solicitors and barristers to review assemble and organise the documents they need to prove their case. Whilst it is often very expensive to pursue Search Orders and some of the interim injunctions we have dealt with, some clients have found them very effective weapons to stop damage being inflicted by employees and former employees or directors.
